GENERAL CONDITIONS VILLA SARTELO

RESERVATION :

For promotional offers and reservations of up to 7 nights, as well as those made within 60 days prior to the arrival date, the customer must pay the full cost of their rental at the time of reservation. For stays longer than 7 nights, you will have 2 days (48 hours) to pay us a deposit. The reservation is confirmed upon receipt of a 50% deposit.

BALANCE PAYMENT :

The balance of payment must be paid at least 60 days before your arrival. If the balance is not received on the due date, Villa SARTELO reserves the right to cancel the reservation, without its right to request cancellation fees being affected, and to keep the deposit.

Particular case : Christmas/New Year's Day between December 15 and January 10 of the following year, the balance must be paid 90 days before the arrival date.

PAYMENTS:

Payment is made via online credit card or by bank transfer. Upon receipt of your payment, we will send you by email a printable confirmation/invoice of your reservation. This confirmation will act as a ''rental contract'', it will be useful to you during your customs clearance.

CONDITIONS OF STAY:

Occupancy of the villa or apartment is strictly limited to the number of people specified when booking and corresponding to the price. In particular, it is strictly forbidden to sublet, or to accommodate additional people without the written consent of Villa SARTELO. The rental contract for the villas and the overall invoicing will only be carried out in one name, with mention of the first and last names of the other tenants. Deposit: A deposit of 1000.-€ will be requested in Euro cash, this will be returned after inventory on the day of the tenants' departure.

 

Progress of the stay and responsibility

Check in Check out

The villa or apartment will be available from 3:00 p.m. on the day of arrival and must be vacated by 10:00 a.m. at the latest on the day of departure. However, if the villa or apartment is available before 2:00 p.m. on the day of arrival, Villa SARTELO will do its utmost to ensure that the client can stay there immediately.. . The accommodation capacity of the villa is limited and recorded in our price and in the reservation voucher (children included). If we notice an excess of the number of people, or if the actions of tenants are contrary to local laws in force, if the client breaks objects or violates basic standards of good manners, we reserve the right to ask tenants to leave the premises immediately, without notice and without reimbursement of the remaining rental days. The client is required to treat the villa and its equipment with the greatest care and consideration. If any damage should occur during their stay, the customer must immediately notify the owner or our local agent, and reimburse the damage or replace the items. The tenant (person who accepted the reservation) also responds for his fellow guests and for the children. In the event that the customer decides to leave the premises of their own free will, if they cancel their reservation or shorten their stay, no refund will be made.

 

LIMITATION OF LIABILITY:

Villa SARTELO cannot be held responsible in the event of the following problems: The water supply (drought, water cuts by government regulation) and/or electricity (power cuts), as well as noise pollution Likewise, any unpredictable natural element, such as (bad weather, cyclones, tides, winds violent...), and likely to modify all or part of the services offered, either by making it impossible for Villa SARTELO to respect the terms of the reservation, or by causing a discrepancy between the reservation voucher and the reality of the moment , cannot engage the direct or indirect liability of Villa SARTELO and no financial or other compensation can be requested. However, in the event of a so-called “force majeure” event, Villa SARTELO will endeavor, as far as possible, to offer a commercial solution in order to satisfy the customer. Access to the swimming pool is strictly reserved for adults and children who know how to swim under the supervision of their parents. Access to the swimming pool is generally not protected and it is up to customers to take all necessary precautions. Villa SARTELO declines all responsibility in the event of an accident. The rental descriptions included in the brochures and websites are valid on the date of their publication. Extension of stay The length of stay can be extended on site subject to availability. In the event that the customer wishes to extend their stay, they must take all the necessary steps for this extension with the airline of their choice and contact Villa SARTELO as soon as possible in order to define the terms of the extension.

 

CANCELLATION AND MODIFICATION FEES

If it is impossible to take your plane (borders closed). 1- No cancellation fees 2- We will give you a credit of the amount collected, and postpone your stay for a period of 12 months.

CANCELLATION AND MODIFICATION FEES FROM THE CUSTOMER

In the event of cancellation by the customer, ''the deposit, insurance and bank charges are not refunded''. Any cancellation or reduction in the duration of the stay by the customer must be confirmed by registered letter before the planned departure date.  Upon receipt of the deposit by Villa SARTELO, the reservation is firm and definitive. In the event of cancellation or reduction in the number of nights, the customer undertakes to pay the balance of the invoice, up to the following cancellation penalties

• Between 90 days and 74 days before the start of the stay: 20% of the total invoice.

• Between 75 days and 45 days before the start of the stay: 50% of the total invoice.

• Between 44 days and 30 days before the start of the stay: 75% of the total invoice.

• Between 29 days and 1 day before the start of the stay: 100% of the total invoice.

We strongly recommend that you take out travel insurance to cover the risk of cancellation fees.

CHANGES OR CANCELLATIONS BY VILLA SARTELO:

Force majeure** (**Exceptional, unpredictable and irresistible event justifying exemption from an obligation, commitment or responsibility). Fire, water damage, death, sale, repossession of the accommodation by the owner... Although it is unlikely that Villa SARTELO will have to make any changes to the confirmed agreements, this may unfortunately happen, for reasons beyond its control. Villa SARTELO reserves the right, after the date of payment of the balance, to cancel or modify all stays, if circumstances beyond its control, including cases of force majeure, make these cancellations or modifications inevitable. Villa SARTELO will notify the client as soon as possible. If, for a reason beyond its control, Villa SARTELO is not able to provide the client with the accommodation that the latter has reserved, it reserves the right to transfer the client to similar accommodation. However, if this proves impossible (no other availability), or if the client does not wish to be transferred to another accommodation, Villa SARTELO will cancel the reservation and refund the amount paid to them. Villa SARTELO will be under no obligation to pay cancellation fees regarding travel arrangements.

RECEIPT OF ACCOMMODATION

In the event that the customer is not satisfied with the villa reserved, he must notify Villa SARTELO upon arrival on site prior to handing over the keys. Subject to the relevance of the reasons for its dissatisfaction, Villa SARTELO will make its best efforts to offer, subject to availability on that date, a substitute villa, of a price level and standing equivalent to those expressed at the time of booking. . Acceptance by the customer of the replacement villa will entail waiver on his part of any right to complain. If the reasons are not justified, no refund will be made. 

Transport aérien

Les retards dus aux compagnies aériennes ne pourront entraîner aucune indemnisation, remboursement ou prolongation de la durée de location.

 

External activities

Sporting or non-sporting activities, visits, excursions and sea trips carried out during the stay are carried out at the customers' own risk, as is the rental of motorized or non-motorized vehicles. Villa SARTELO cannot be held liable in the event of services provided by a third party, even advised by Villa SARTELO or one of its representatives. Delays due to airlines cannot result in any compensation, reimbursement or extension of the rental period.

Activities offered by Villa SARTELO

Visits, excursions, transport, sea trips, sporting or other activities offered by Villa SARTELO are organized under the full responsibility of Villa SARTELO's subcontractors. Villa SARTELO cannot under any circumstances be held responsible for any accident occurring during a visit to the sea or the practice of one of these activities whatever it may be and no physical, moral or financial compensation can be claimed from it. Although Villa SARTELO strives to seek constant quality in the selection of its subcontractors, all complaints regarding quality or service must be made on site during the activity to the subcontractor of Villa SARTELO, it belongs directly to the subcontractor of Villa SARTELO to make every effort to satisfy its request. If no arrangement between these parties could be found, it is up to them to make their grievances known to Villa SARTELO in writing, we reserve the right to award possible compensation if it turns out after analysis that, clearly, the subcontractor of Villa SARTELO failed in its obligations. In any case, compensation can never exceed reimbursement of the price of the service itself. The customer has the choice to reserve for himself, during his stay, the dates on which he wishes to carry out the activities and visits that he has reserved at Villa SARTELO or to ask Villa SARTELO to make the date reservations before his arrival. Villa SARTELO cannot be held responsible for the cancellation of a service by its subcontractor, whether due to unfavorable climate, force majeure, security reasons, insufficient minimum reservation, or any other arguments emanating from the subcontractor. that he will have to justify. If possible this will be postponed to a later date. In the event of impossibility of execution, the price of the activity will be refunded. Any service started will under no circumstances be refundable, whether in whole or in part.

Liability, Litigation

No dispute regarding the price of the trip will be taken into consideration upon return. It is up to the customer to assess before departure whether the price suits them. To take into account any observations or shortcomings regarding the progress of the stay, must be reported to Villa SARTELO by registered letter within 24 hours following the problem, attaching all supporting documents for the damage suffered, so that it can possibly be considered commercial compensation. Villa SARTELO is bound by an obligation of means hereunder. If the liability of Villa SARTELO were to be recognized in respect of a service ordered pursuant to these terms, the maximum amount of damages to which it could be ordered is in any event capped at the price received by Villa SARTELO for the service. in question. In the event of a dispute or disagreement, it is agreed that prior to any legal action, the parties will make every effort to resolve their dispute amicably. However, if attempts at amicable reconciliation prove unsuccessful and in the event of disagreement or persistent difficulty regarding the interpretation and execution of this contract, the dispute will be submitted to the Court of Port-Louis - Mauritius, being specified on this point that the contractual agreements and their possible annexes are entirely subject to the provisions of Mauritian law.
